Sears Faces Another Lawsuit Over Peeping Employee

A second civil lawsuit is being filed against Sears over a North Hollywood store employee who secretly videotaped scores of women and children in fitting rooms and bathrooms during a three-year period and posted the footage online, according to NBC4.

Alejandro Gomez, 28, was arrested in April and sentenced to a year in prison for installing 60 motion-detector cameras to peep on his victims. He also faces three years probation upon release.

Although it was Sears that reported Gamiz to the police after employees discovered the hidden cameras, the new lawsuit alleges there were some red flags the store failed to notice, according to NBC4.

"Each day he came to work, Gamiz would enter the women’s fitting room, sometimes empty-handed, and spend a substantial amount of time in there, which was recorded by Sears’ own video recording system . . . " the lawsuit read. “Despite Gamiz’s outwardly suspicious and questionable behavior, and the numerous, glaring 'red flags' his behavior created, Sears never questioned Gamiz's conduct.”

A Sears spokesman defends the department store in a statement saying no one knew of Gamiz's conduct until the investigation into the cameras began.

A similar lawsuit was filed earlier this year. The new suit, filed by 25 women and a minor, has not specified a dollar amount for damages.
